What is Probate?
Probate is the term used for the legal process in dealing with a person’s assets/liabilities known as their ‘Estate’ after they are no longer with us and they have left a valid Will.
Probate Process
When somebody passes away, the Estate will either be distributed in accordance with the terms of their Will or in the unfortunate event that they did not make or leave a valid Will, their estate is administered in accordance with the rules set down by law, which is known as “intestacy”.
In many situations, an application is made to the Court for a Grant of Probate (if there is a Will) or a Grant of Letters of Administration (where there is no Will).
