A recent County Court success has highlighted the expertise and determination of the Dispute Resolution team at Barker Booth & Eastwood, after securing judgment for a client whose holiday rental property was left devastated by fraudulent guests.
The case involved a property owner who suffered losses approaching £50,000 after guests booked through an online holiday rental platform using a stolen identity and somebody else’s credit card. Following the incident, the property had been extensively damaged, ransacked and valuable items stolen.
As the fraudulent guest could not initially be traced by the police, the client faced the possibility of recovering none of their losses. However, through detailed investigation and careful preparation of the claim, Barker Booth & Eastwood uncovered crucial evidence that ultimately proved pivotal at trial.
It emerged during proceedings that the same email address used to make the fraudulent booking had also been linked to an earlier attempted booking for another property just two days before. That previous booking had already been flagged internally by the holiday rental company as a potential fraud risk after multiple failed payment attempts under a different name and address.
The Court found that the holiday rental company should have had sufficient systems in place to identify and link the suspicious activity. By allowing the booking to proceed without further checks or the property owner’s consent, the company was found to have breached its duty of care.
Following a successful County Court trial, Barker Booth & Eastwood secured judgment covering the client’s substantial financial losses.
The matter was handled by members of the firm’s Dispute Resolution team, including Jack Fielding and Tim Fielding, alongside instructed Counsel.
